All users of ITA Direct Access are required to accept and abide by the terms and conditions of use.

ITA Direct Access Terms and Conditions

The parties to this Agreement are The Industry Training Authority (the “ITA”) and the person or individual (“you”) that has been or will be issued an ITA Direct Access account.

You are deemed to have accepted this Agreement by specifying that you have read and accepted these Terms of Use on this Web page. The ITA, upon receipt of your completed new account information may, at its sole discretion, issue you an ITA Direct Access account. If the ITA does not issue you a  ITA Direct Access account, this Agreement is rescinded.

In consideration of the ITA providing you with a ITA Direct Access account, you agree as follows.

1. You agree to abide by the terms of this Agreement.
2. You consent to the collection of your account information.
3. You will not:
   1. permit any third-party to use your ITA Direct Access account user ID or password;
   2. divulge, share or compromise your ITA Direct Access account password;
   3. use or attempt to use the ITA Direct Access account user ID of any other person;
   4. test or examine the security related to  ITA Direct Access ;
   5. take any action that might reasonably be construed as compromising, altering or rendering ineffective the ITA Direct Access system; or
   6. decompile, disassemble or reverse engineer the ITA Direct Access system.
4. The ITA may at its sole discretion cancel or modify the access level of your ITA Direct Access account at anytime, for any reason, including, but not limited to the following:
   1. you fail to abide by this Agreement;
   2. as a security measure;
   3. for administrative purposes; or
   4. you are no longer participating in the same capacity in the Industry Training System as when the Agreement was originally made.
5. You agree that the ITA is not responsible for any costs, losses or damages you may incur because of matters inside or outside of its control including:
   1. the availability of the Internet;
   2. because the ITA Direct Access service is not available for any reason;
   3. because you failed to comply with this Agreement; or
   4. inaccuracy of information on  ITA Direct Access.
6. You agree not to use your ITA Direct Access account for any purpose other than to access e-Services offered by the ITA.
7. You agree to be bound by any changes to this Agreement that may, from time to time, be published on the ITA Web Site.
8. You agree that you may have to apply, and be approved, for access to some e-Services.
9. You agree to observe the Terms of Use of all e-Services accessed using your  ITA Direct Access  account and to maintain your awareness of those terms current at the time of access.
10. You agree that the ITA Direct Access service is provided “as is”, without warranty of any kind, either express or implied, with respect to accuracy of information, or system performance, quality, merchantability or fitness for a particular purpose. The ITA does not warrant that  ITA Direct Access  will function without error, failure or interruption.
11. You will not, without the prior written consent of the ITA, assign or transfer this Agreement or any of its rights under this Agreement.
12. This Agreement is governed by and is to be construed in accordance with the laws of British Columbia including the Freedom of Information and Protection of Privacy Act (FOIPPA).
    1. You agree that access, use and disclosure of personal information on ITA Direct Access will be governed by FOIPPA and also by ITA Information Sharing Agreements to which you are a party.
